Copyright & Author Rights

Journal of Surgery and Medicine (JOSAM) is an open-access journal. The content in the JOSAM is protected by copyright. Copyright protection applies automatically to any original work as soon as it is written down or put into permanent or fixed form. There does not need to be a © symbol next to the work for it to be protected by copyright. It generally lasts for 70 years after the death of the author (or the last remaining co-author).

Authors who publish with this journal agree to the following terms:

JOSAM permits only one corresponding author per submission. This person is solely responsible for all correspondence with JOSAM and will receive all emails regarding forms, authorship issues, manuscript files, etc. Editors will speak only with the corresponding author regarding manuscript submissions.

Authors keep/hold the copyright and grant the journal right with the work (at the same time) licensed under a Creative Commons Attribution-NonCommercial-NoDerivatives 4.0 (CC BY NC ND) license that allows others to share the work with an admission/response/recognition of the work's authorship and initial (book, magazine, etc.) in this journal. Publication under a Creative Commons Attribution-NonCommercial-NoDerivatives 4.0 (CC BY NC ND) license allows users to copy and distribute the article, provided this is not done for commercial purposes, and further does not permit distribution of the article. If it is changed or edited in any way and provided the user gives appropriate credit (with a link to the formal publication through the relevant DOI), provides a link to the license, and that the licensor is not represented as endorsing the use made of the work.

Authors can enter into separate, added/more (based on a written agreement) arrangements for the non-exclusive distribution of the journal's published version of the work (e.g., post it to an institutional storage place or publish it in a book), with an admission/response/recognition of its initial (book, magazine, etc.) in this journal. 

Authors are permitted and encouraged to post their work online (e.g., in institutional storage places or on their website) before and during the submission process, as it can lead to productive exchanges, as well as earlier and greater citation of published work.

You are free to:

Share — copy and redistribute the material in any medium or format
The licensor cannot revoke these freedoms as long as you follow the license terms.

Under the following terms:
Attribution — You must give appropriate credit, provide a link to the license, and indicate if changes were made. You may do so in any reasonable manner, but not in any way that suggests the licensor endorses you or your use.
NonCommercial — You may not use the material for commercial purposes.
NoDerivatives — If you remix, transform, or build upon the material, you may not distribute the modified material.

No additional restrictions — You may not apply legal terms or technological measures that legally restrict others from doing anything the license permits.


Upon submission of their article, authors are requested to complete an assignment of copyright and publication agreement.


Copyright Release Form

On behalf of all authors, as the corresponding author of the manuscript, I warrant that

  1. the manuscript submitted is my/our own original work;
  2. all authors participated in the work in a substantive way and are prepared to take public responsibility for the work;
  3. I was authorized by all authors to transfer all royalties related to the manuscript and to enter into a binding contract with

JOSAM as detailed in this Copyright Release Form, and I will be responsible in the event of all disputes that have occurred and that may occur,

  1. all authors have seen and approved the manuscript as submitted;
  2. e-mail and street addresses of all authors have been entered into the JOSAM and Evaluation System correctly,
  3. the manuscript has not been published and is not being submitted or considered for publication elsewhere;
  4. the text, illustrations, and any other materials included in the manuscript do not infringe upon any existing copyright or other rights of anyone.
  5. I transfer all financial rights, especially processing, reproduction, representation, printing, distribution, and online transmittal, to JOSAM with no limitation whatsoever,

Notwithstanding the above, the Contributor(s) or, if applicable the Contributor’s Employer, retain(s) all proprietary rights other than copyright, such as
a) patent rights;
b) to use, free of charge, all parts of this article for the author’s future works in books, lectures, classroom teaching, or oral presentations;
c) the right to reproduce the article for their own purposes provided the copies are not offered for sale.

However, reproduction, posting, transmission, or other distribution or use of the article or any material contained therein, in any medium as permitted hereunder, requires a citation to the Journal and appropriate credit to JOSAM as a publisher, suitable in form and content as follows: Title of article, author(s), journal title and volume/issue, Copyright© year.

As the corresponding author, I also warrant that “JOSAM and the Journal Editors” will not be held liable against all copyright claims of any third party or in lawsuits that may be filed in the future, and that I will be the only person who will be liable in such cases. I also warrant that the article contains no libelous or unlawful statements, I/we did not use any unlawful method or material during the research, I/we obtained all legal permissions pertaining to the research, and I/we adhered to ethical principles during the research.
